DeVry University & Department of Education Reach Resolution 

Dear Victor,

I am pleased to share that DeVry University reached a resolution with the U.S. Department of Education (“the Department”) regarding the limitations action initiated in January 2016, which focused on our graduate employment records for the period 1975 to 1980, and their use in advertisements. While we believed in good faith DeVry University had sufficient substantiation at the time these ads ran, we agreed to a settlement to keep our resources and our people focused on our purpose… empowering students to achieve their educational and career goals.

I would like to highlight several key points related to the settlement:

• At no time has the Department challenged the value of a DeVry University education or its academic quality, nor did it accuse the university of any fraudulent acts. The matter came down to a disagreement about how the “since 1975” employment statistic was substantiated. DeVry University remains accredited by The Higher Learning Commission (HLC). The HLC is a regional agency that accredits U.S. colleges and universities at the institutional level; and is recognized by both the U.S. Department of Education and the Council for Higher Education Accreditation.

• The Department and DeVry University have come to an agreement regarding the “since 1975” representation. The Department maintained that DeVry University needed student-level employment data for the years 1975-1980, as well as Career Services manuals through 1983, to substantiate the ads. DeVry University had campus-level employment data through October 1980, and had student-level data from October 1980 forward, and Career Services manuals from 1983 onward. As such, DeVry University agreed to no longer use “since 1975” representation.

• This resolution will not hinder our ability to provide federal financial aid funding to current or future students. DeVry University is able to continue to participate in Title IV programs. We will be subject to provisional certification and must post a letter of credit. Provisional certification is a heightened form of monitoring by the Department.
