THE PLANNING BOARD OF THE CITY OF BURBANK FINDS:
A. The Planning Board of the City of Burbank at its meeting of October 27, 2008, held a public hearing on Project No. 08-0004354, City Planner Classification Conditional Use Permit, as applied for by Contract Services Administration Training Trust Fund, to allow for the operation of an Industrial Training Facility to be located at 2800 Winona Avenue, Burbank, California, in the M-2, General Industrial zone.
B. Said hearing was properly noticed in accordance with the provisions of Section 10-1-1942 of the Burbank Municipal Code.
C. The Planning Board considered the report and recommendations of the City Planner and the evidence presented at such hearing.
D. The project is Categorically Exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the State CEQA Guidelines pertaining to interior or exterior alterations to existing facilities.
THE PLANNING BOARD OF THE CITY OF BURBANK RESOLVES:
1. The application for Project No. 08-0004354, City Planner Classification Conditional Use Permit as described above is hereby approved subject to the applicant complying with all of the requirements of the Burbank Municipal Code (BMC) and the Conditions of Approval (Exhibit A) to this resolution. The approval is based on the ability of the Planning Board to make each of the following findings:
REQUIREMENTS FOR GRANTING A CONDITIONAL USE PERMIT:
(1) The use applied for at the location set forth in the application is properly one for which a conditional use permit is authorized by Chapter 31 of the Burbank Municipal Code.
Burbank Municipal Code (BMC) section 10-1-503 states that the City Planner may classify any use in any zone as a conditionally permitted use when it is determined to be substantially similar to other uses permitted in that zone. An Industrial Training Facility is not on the Use list but is similar to both Motion Picture Studios and equipment rental businesses.
(2) The use is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located.
The industrial training facility will not be detrimental to uses permitted or existing in the M-2 zone because it is substantially similar to the existing industrial neighborhood. Based on the similarities of the proposed business and the existing businesses, as well as the conditions of approval placed on the project, staff feels that the industrial training facility will not be detrimental to the surrounding businesses.
(3) The use will be compatible with other uses on the same lot, and in the general area in which the use is proposed to be located.
The proposed industrial training facility will be compatible with other uses in the area. Many of the existing businesses, including ones that are immediately adjacent to the subject property, utilize the same type of equipment as the proposed use. The proposed use is consistent and compatible with the industrial nature of the surrounding neighborhood.
(4) The site for the proposed use is adequate in size and shape to accommodate the use and all of the yards, setbacks, walls, landscaping, and other features required to adjust the use to the existing future uses permitted in the neighborhood.
The site is adequate in size and shape to accommodate the proposed use. The site is approximately 2.24 acres and includes a 19,613 square foot building that is set back 25 feet from the front property line. There is more parking on-site than required and the landscaping requirements have been met although it is not required for an existing lot. Interior improvements are proposed but no major structural changes to the existing building will occur.
(5) The site for the proposed use relates to streets and highways properly designed and improved to carry the type and quantity of traffic generated or to be generated by the proposed use.
Potential traffic to be generated by the industrial training facility will not have an adverse effect on the surrounding businesses or streets. The project site is served by a four lane road (Winona Avenue) which can accommodate the type and quantity of traffic to be generated by the proposed use.
(6) The conditions imposed are necessary to protect the public health, convenience, safety, and welfare.
The conditions of approval for this project are intended to ensure that there are no impacts on the surrounding neighborhood or businesses.
2. The Secretary of the Planning Board shall mail a copy of this Resolution to the applicant and report this decision to the City Council in accordance with Section 10-1-1946 of the Burbank Municipal Code.

1. Project No. 08-0004354, City Planner Classification Conditional Use Permit, allows for the operation of an Industrial Training Facility with 3,609 square feet of classroom area, 14,840 square feet of office area including a newly constructed 993 square foot mezzanine area for storage, and an outdoor hands-on safety training area with a minimum 123 space parking lot at 2800 Winona Avenue in the M-2, General Industrial zone.
2. All training activities shall take place on the subject property located at 2800 Winona Avenue.
3. No outdoor training activity shall obstruct access to any of the required parking spaces at any time.
4. The appropriate permit shall be obtained for any signs proposed on the property.
5. If at any time the number of students exceeds 54 the applicant shall notify the City to ensure that there is enough required parking for the use.
6. The use of machinery and equipment outside is limited to training activities only and shall not be permitted otherwise.
7. The applicant shall comply with all applicable provisions of the Burbank Municipal Code and obtain all necessary permits as required for the subject structure.
8. Project No. 07-0004354, Conditional Use Permit, may be modified or revoked by the City should it be determined that the proposed use or conditions under which they were permitted are detrimental to the public health, welfare, or materially injurious to property or improvements in the vicinity or if the use is maintained so as to constitute a public nuisance.
9. The applicant shall comply with all federal, state, and local laws. Violations or convictions of any of those laws in connection with the use will be cause for revocation of this permit.
10. By signing and or using this permit, the permittee acknowledges all of the conditions imposed and accepts this permit subject to those conditions and with full awareness of the provisions of Burbank Municipal Code Sections 10-1-1951 and 10-1-1952. Failure of the permittee to sign these conditions does not affect their enforceability by the City or other responsible entity. These conditions are binding upon all future property owners and occupants of the subject property.
